About Berthr

Berthr is a sailing guest management and communication platform for recreational boat owners ("captains"). By creating an account or using the service, you agree to these terms.

Nature of the service

Berthr is a communication and organisation tool for managing boat guests, trips, and logs. It is provided for recreational use only.

Safety responsibility: Captains are solely responsible for the safety of all persons aboard their vessel. Berthr is a communication and administrative tool — it is not a navigation aid, safety system, or substitute for proper seamanship. Nothing in Berthr's output constitutes safety or navigation advice.

The AI assistant provides general information about the boat and trip based on content the captain provides. Its responses are not a substitute for direct communication with the captain on matters of safety, health, or emergency preparedness.

Accounts and access

One account corresponds to one boat owner (captain). Accounts are not transferable.
You are responsible for maintaining the security of your account and for all activity under it.
Captains sign in via Google OAuth or a one-time code sent to their email — no password is stored by Berthr.
You must provide accurate information when setting up your account, including your boat name, marina, and contact details.

SMS usage

Paid plans (Crew and Captain) include a monthly SMS allowance for sending invitations, reminders, and automated messages to guests. SMS is provided through a dedicated phone number assigned to your account.

Crew plan: 100 SMS/month included.
Captain plan: 400 SMS/month included.
SMS is not available on the Free plan.
Unused SMS credits do not carry over to the next month.
You may not use Berthr's SMS capabilities to send unsolicited commercial messages or for any purpose other than managing your boat guests.

Acceptable use

You agree not to use Berthr to:

Send spam or unsolicited messages to any person.
Harass, threaten, or harm any guest or third party.
Violate any applicable law, including Canadian anti-spam legislation (CASL).
Attempt to gain unauthorised access to another user's account or data.
Reverse-engineer, scrape, or abuse the platform or its APIs.
Upload content that is illegal, defamatory, or infringes on third-party rights.

Account termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behaviour, or are inactive for an extended period. You may close your account at any time by contacting support@berthr.app — all associated data will be permanently deleted.

Service availability

Berthr is provided on an as-is basis. We make no guarantee of uninterrupted uptime or availability. The service may be unavailable for maintenance, updates, or reasons beyond our control.

We reserve the right to modify or discontinue any feature of the service with reasonable notice.

Limitation of liability

To the maximum extent permitted by law, Berthr and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service — including but not limited to loss of data, missed communications, or events related to vessel safety.

Our total liability to you for any claim arising under these terms is limited to the amount you paid for the service in the 12 months preceding the claim.

Changes to these terms

We may update these terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated by email to the address on your account.

Governing law

These terms are governed by the laws of Ontario, Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.
